Payments: You understand and agree that by completing and signing this Enrollment Form, if accepted into the Training Program, you authorize Home Care Sales LLC. to charge your credit card(s) the total amount of the Enrollment Fee as payment in full or by installment payments based on your selected investment option. Prior to attending any Event, you must have paid at least 75% of the total Enrollment Fee for the Training Program/Event. Your account must be current under the terms of these Terms and Conditions before the start date of the Training Program and before attending any Event. If you do not pay by the agreed-upon date(s), then you will be in default of these Terms and Conditions. You agree and acknowledge that you are committing to make all installment payments as agreed or you will be subject to having your account turned over to collections. In the event your account is turned over to collections due to non-payment of any installment when it is due and payable, you may also be responsible for paying any attorney’s fees and collection fees related to the collections process. In addition, if you miss any installment payment when it comes due, you understand your participation in the Training Program will be forfeited unless payment is made (or a payment agreement is made) within 10 days of being notified. You agree that we have the right to charge alternative credit card(s) on file for any past due balances or any administrative/change fees outlined in these Terms and Conditions.
Confidentiality: The Company’s intent is to keep personally identifying information shared by you confidential. Information that is permitted or required to be shared because of applicable laws or statutes or as a matter of public safety will not be kept confidential. From time to time, your Training Program Sessions and Events may be monitored or recorded as part of our ongoing quality process and you consent to such recordings. You recognize and agree that you have no expectation of confidentiality for any comments or actions that you voluntarily make publicly as part of your participation in the Training Program and/or Events.
Rescheduling Requests: You understand and agree if you are unable to attend an Event, you may choose to transfer your attendance to a later Event provided it is held within the next 12 months; however, if no dates are scheduled for the same Event in the future or there are no available seats, you are agreeing to forfeit your attendance and investment in the Event completely. Due to the small group size, if you cannot attend the scheduled date(s) and request to attend the same Event held at a later date, you will be charged 50% of the list price of the event you wish to change and placed on a waitlist with no guarantee of placement at a future Event.
72 Hours Cancellation: You may cancel this tarnation without penalty by submitting a signed dated written notice postmarked prior to midnight of the 3rd business day after the date of this agreement
Termination: If accepted into the Training Program or Event, we reserve the right to terminate your participation should you violate any of the terms of these Terms and Conditions or should we deem that you are not an appropriate fit for the Training Program/Event. You acknowledge that we will retain as an administrative and materials fee of $995 USD regardless of whether you completed any Training Program sessions or attended any Event. We are not liable for any other personal or business expenses that may be incurred by you in connection with the Training Program/Event. The Enrollment Fee is non-refundable once the Event has commenced.
Dates Subject to Change: Dates, times, locations, and structure of the Training Program and Event(s) are subject to change at any time.
Dispute Resolution: Any and all unresolved disputes regarding these Terms and Conditions shall be settled by binding arbitration before a single arbitrator, using the Commercial Rules of the American Arbitration Association, in Fairhope, AL. Should there be a conflict of laws, the laws of the State of Alabama shall govern. If it becomes necessary to enforce these Terms and Conditions through legal action, then Company shall be entitled to recover all reasonable attorney fees and costs incurred.
Your approval of each of the terms in these Terms & Conditions is required prior to commencement of your participation in the Training Program and/or Event. Your signature on the front of this Enrollment Form affirms that you have read and that you agree to all of the Terms & Conditions above and you wish to proceed to be considered for participation in the Training Program and/or Event(s) as applicable.
